2. Applicability

These Terms and Conditions apply to every offer made by Lab Jewels and to every distance contract concluded between Lab Jewels and you as a consumer.

Before completing your order, you must explicitly agree to these Terms and Conditions. You can save or download them for your own records.

3. Offer and agreement

We describe our products as fully and accurately as possible. Obvious mistakes or errors, such as an obviously incorrect price or description, are not binding.

The agreement is concluded once you have completed the order process and payment has been successfully processed. You will receive an order confirmation by email.

4. Prices and payment

All consumer prices are stated inclusive of VAT and other mandatory charges, excluding shipping costs unless stated otherwise.

Payment is processed via the payment methods offered in the checkout. Orders are shipped only after full payment has been received.

Promotions and discount codes cannot be combined and may be subject to additional conditions.

5. Delivery and performance

We ship orders via PostNL or an equivalent carrier. For deliveries outside the Netherlands, a local delivery partner may be used.

Delivery times stated on the product page or during checkout are indicative. We make every effort to deliver within these timeframes.

If delivery is delayed or if part of your order cannot be fulfilled, you will be informed as soon as possible. In such cases, you are entitled to terminate the agreement free of charge. Any amounts paid, including shipping costs where applicable, will be refunded within 14 days.

The risk of loss or damage passes to you at the moment of physical receipt of the product.

6. Right of withdrawal and returns

Orders placed through our webshop are subject to the statutory right of withdrawal.

The method of exercising this right, applicable time limits, exceptions, return instructions, possible depreciation and refunds are fully described in our Refund Policy, which forms an integral part of these Terms and Conditions.

Hygiene exception (earrings):
Earrings are excluded from the right of withdrawal only if they are delivered sealed for hygiene reasons, such as in a sealed bag or with a seal or sticker, and this seal has been broken after delivery. The exact conditions and procedure are described in our Refund Policy.

7. Warranty and conformity

You are entitled to receive products that comply with the agreement and meet reasonable expectations based on their nature and price, in accordance with statutory conformity requirements.

If a product proves to be non-conforming within a reasonable period under normal use, you are entitled to free repair, replacement, or, if this is not possible or reasonable, a full or partial refund.

Damage or defects resulting from improper use, accidents, modifications by third parties or normal wear and tear are excluded from these statutory rights.

These statutory consumer rights remain fully applicable, even if the business activities of {{ shop.name }} change or cease in the future.

8. Liability

We perform our obligations properly and in accordance with the agreement and applicable law. We are not liable for damages resulting from improper use of the product.

In consumer relationships, liability is assessed in accordance with principles of reasonableness and fairness and cannot be excluded where exclusion is not permitted by law.

9. Force majeure

In the event of force majeure, such as carrier disruptions, natural disasters, strikes or government measures, our obligations will be suspended for the duration of the force majeure situation.

If the force majeure situation lasts unreasonably long and performance becomes permanently impossible, both parties are entitled to terminate the agreement. Any advance payments made for undelivered products will be refunded.

10. Complaints

If you have a complaint, please submit it as fully as possible via the contact form.

You will receive a substantive response within 14 days of receipt, or, if more time is required, a message indicating the expected response period. Submitting a complaint does not suspend our obligations unless confirmed by us in writing.

11. Governing law and competent court

These Terms and Conditions and all agreements between you and Lab Jewels are governed by Dutch law.

Disputes may be submitted to the competent Dutch court. Mandatory consumer protection rights applicable in your country of residence within the European Union remain fully applicable.

12. Changes

Lab Jewels may amend these Terms and Conditions. The most recent version is always available on the website.

The Terms and Conditions applicable at the time of your order shall apply, unless immediate application of an amended version is required by law.
